1. Purpose
This policy establishes rules for text, photographs, logos, trademarks, videos, artwork, descriptions, listings, reviews and other materials submitted or published by users, businesses, agencies and advertisers on SóGuia.
2. Responsibility for submitted content
Anyone submitting content to SóGuia represents that they have the rights, licenses, authorizations or other legal basis necessary to use and publish it. The person responsible for the submission must respect copyright, trademarks, image rights, reputation, privacy, data protection and other third-party rights.
3. License required for display
By submitting content for publication on SóGuia, the responsible party grants a non-exclusive authorization, for the period necessary to provide the service, for hosting, technical reproduction, format adaptation and display within the platform and in promotional features linked to the relevant listing or advertisement. This authorization does not transfer ownership of the content to SóGuia.
4. Images, logos and trademarks
Photographs, artwork, logos and trademarks must be owned, licensed or used with appropriate authorization. Third-party material may not be used in a way that could mislead the public about authorship, partnership, representation, origin or commercial relationship.
5. Third-party content
SóGuia may moderate materials submitted by third parties and take action when it identifies signs of infringement. Moderation does not replace the responsibility of the person who published the content and does not constitute prior validation of all rights involved.
6. Prohibited content
Unlawful, fraudulent, misleading, discriminatory, offensive or malicious content, content that violates third-party rights, improperly exposes personal data or is incompatible with the platform’s purpose and rules may be rejected or removed.
7. Rights-holder complaint
An author, photographer, rights holder or legal representative who identifies possible misuse of a work, photograph, image, trademark or other protected content may request review and removal through SóGuia’s contact channels. The notice should identify the material in question, state the page where it appears, provide sufficient information about authorship or ownership and include a means of contact.
8. Measures after a complaint
Upon receiving a sufficiently identified request, SóGuia will review it in good faith and with priority. If the request is substantiated, SóGuia will, as promptly as possible, remove the content, regularize its use or, where requested and legally appropriate, correct the authorship credits. SóGuia may temporarily restrict access while investigating the complaint and may request documents or clarification when necessary.
9. SóGuia-owned content
SóGuia’s visual identity, brand, code, layout, institutional text and other proprietary elements are protected by applicable law and may not be copied or exploited except as authorized by law or with permission from the relevant rights holder.
10. Privacy and personal data
Content containing personal data is also subject to the Privacy Policy. Submission of images or personal information relating to third parties must comply with applicable law and required authorizations.
11. Related legislation
This policy applies together with the Terms of Use and takes into account, as applicable, Law No. 9,610/1998 (Copyright), Law No. 9,279/1996 (Industrial Property), Law No. 13,709/2018 (LGPD), Law No. 12,965/2014 (Brazilian Internet Civil Framework) and other applicable rules.
12. Contact and removal request
Requests related to content, photographs, images, trademarks or copyright may be sent to contato@soguia.com.br. Use Copyright / Removal Request in the subject line and, whenever possible, include your name, the page URL, identification of the content and information demonstrating authorship, ownership or representation.
Important: this takedown procedure does not replace authorization, a license or another legal basis where one is required to use the content.
